Disability Benefits

Workers' Compensation and Disability Wage Benefits

A disability benefits attorney may be able to help you collect benefits that you weren't aware of. Oregon workers' compensation laws are designed to offer a certain measure of protection to workers who suffer work-related injuries. Unfortunately, disability wage benefits only pay a portion of your lost wages.

If you have suffered a work-related injury, you may be eligible for these and other benefits:

  • Temporary Partial Disability: You may receive Temporary Partial Disability (TPD) benefits if you are only able to return to work part-time or must take a lesser paying job for a limited period of time.
  • Temporary Total Disability: If you are unable to return to any type of job for a limited period of time, you may receive Temporary Total Disability (TTD) benefits. Typically, TTD payments equal two-thirds of your previous gross income.
  • Permanent Partial Disability: You may receive Permanent Partial Disability (PPD) benefits for the loss of a body part or loss of proper functioning of a body party. The amount of PPD benefits you receive depends on the severity of impairment.
  • Permanent Total Disability: You may receive Permanent Total Disability (PTD) payments if you are completely unable to return to any form of gainful employment because you have lost the use or function of a part of your body.

If you suffer from a workplace injury, it is critical that you contact an experienced workers' compensation attorney as soon as possible.

At The Law Offices of Brian R. Whitehead, our attorney has over 25 years of experience helping clients seek out workers' compensation and disability wage benefits when they have been injured on-the-job. Put our experience to work for you.

Your Eligibility and Your Rights

You do have a right to receive disability wage benefits if you aggravated a pre-existing condition. You have a right to receive compensation for a physical or mental injury that has impaired your ability to work. If you have a disease caused by work-related conditions, you have a right to receive workers' compensation benefits.

In addition to workers' compensation benefits, you may also have a right to pursue a third party liability claim (personal injury lawsuit) if your injury was caused in part by the party that is not your employer. Visit our frequently asked questions page to learn more about your rights.
